TERMS AND CONDITIONS JAKESAX

1. Booking Confirmation:

  • A booking is considered confirmed only upon receipt of the agreed-upon deposit payment.

  • Dates are not reserved until a booking confirmation deposit has been sent.

  • Payment of this deposit constitutes the client's full understanding and acceptance of these Terms and Conditions.

2. Payment Terms:

  • A non-refundable deposit of 40% of the total fee is required to secure the booking.

  • The remaining balance is due latest on arrival to the event.

  • Payment can be made via bank transfer for deposits and via cash or bank transfer for the remaining balance.

  • If remaining payment is not made before performance, the performance will not take place and I reserve the rights to maintain the deposit.

  • The booking fee covers the agreed-upon hours of live saxophone performance. Please note that this does not encompass the time required for setting up equipment prior to the performance commencing or dismantling and packing down equipment once the performance concludes. The client is responsible for ensuring adequate time within the event schedule for these logistical requirements, which typically amount to approximately 15 minutes before and 15 minutes after the scheduled performance.

3. Cancellation by the Client:

  • In the event of cancellation by the client, the deposit is non-refundable.

4. Cancellation or Postponement by Jake's Sax:

  • In the unlikely event that Jake's Sax is unable to perform due to unforeseen circumstances (e.g., illness, accident), all payments made by the client will be refunded in full. Jake's Sax will endeavor to find a suitable replacement musician, subject to the client's approval, but cannot guarantee this.

  • If the event is postponed by the client, the booking may be transferred to a new date subject to availability. The deposit will be transferred to the new date. If a mutually agreeable new date cannot be found, the cancellation terms outlined in section 3 will apply.

5. Performance Requirements:

  • The client is responsible for providing a safe and suitable performance area, including adequate space, shelter from the elements (if outdoors), and access to a power outlet if required for amplification.

  • The client will ensure a reasonable setup and pack-down time is allocated (typically 10 minutes each).

  • Any specific technical requirements should be communicated and agreed upon in advance.

6. Musical Content:

  • Jake's Sax will perform a setlist appropriate for the event type, as discussed and agreed upon with the client.

  • Specific song requests can be accommodated where possible, provided they are communicated in advance (ideally no later than 4 weeks before the event). Jake's Sax reserves the right to refuse to play songs deemed unsuitable.

7. Liability:

  • Jake's Sax holds public liability insurance. However, the client is responsible for ensuring the safety and security of the performance area and attendees.

  • Jake's Sax will not be liable for any loss, damage, or injury caused by the client, their guests, or venue staff.

8. Force Majeure:

  • Neither party shall be liable for any failure to perform its obligations where such failure is a result of circumstances beyond its reasonable control (Force Majeure), including but not limited to acts of God, natural disasters, war, civil unrest, strikes, or significant changes in law. In such circumstances, reasonable efforts will be made to find a mutually agreeable solution.
